Privacy Policy of Alberding GmbH

Alberding GmbH takes the protection of personal data very seriously and handles this data confidentially in accordance with legal regulations. In our data protection declaration we inform you about how we collect and process your data and how you can exercise your rights under the EU General Data Protection Regulation (GDPR). The scope of personal data depends on the respective contractual relationship.

  3. Categories of personal data
  4. Depending on the contractual relationship, the following personal data is stored:

    1. Website visit
    2. Alberding GmbH collects data about access to the website and saves it as "server log files". The following data is stored when you visit the website:

      • Accesed Website
      • Time of access
      • Amount of data sent in bytes
      • Source/reference from which you came to the page
      • Browser used
      • Operating system used
      • IP address used

      The data collected about your visit to the website is used solely for statistical analysis and to improve our website. However, Alberding GmbH reserves the right to subsequently check the server log files if there are concrete indications of illegal use.
      For security reasons, the server log files are normally stored for a maximum of 7 days and then deleted. In the event of unlawful use, the log files can be stored as evidence until the incident has been finally clarified.

    3. Inquiry for contact
    4. If you make a product request by filling out the contact form, the following personal data will be stored in addition to the server log files:

      • First name, surname
      • Address
      • Communication data (telephone number, e-mail address)
      • Occupation-related information
      • Customer group/interests

      The personal data from inquiries of contacts are stored for the distribution of information material or an offer. If no customer relationship results from the contact, the personal data will be deleted after 90 days.

    6. For customers with whom Alberding GmbH has a business relationship, the following personal data is stored in addition to 2b:

      • Contract-related master data
      • Payment data / account details
      • Account information, especially registration and logins
      • Customer group
      • Customer number
      • Contact history
      • Appointment data
      • Invoice data/sales data
    7. Contractual partners and users of Alberding Positioning Services
    8. When you use one of the Alberding Positioning Services, we collect, process and store information about the locations of the GNSS sensors with precise time allocation and information about the quality of the positioning. The operators of the respective Positioning Service, as well as correspondingly authorized users of the Alberding Positioning Services can view the movement and position data of the sensors. Alberding GmbH will store the device position data as contractually agreed. The data collected within the framework of the Positioning Services will only be used for the fulfilment of the contractually guaranteed purposes and will not be passed on to external third parties.

  5. Sources used to obtain the personal data
  6. Alberding GmbH processes personal data that we receive from customers, interested parties, service providers and suppliers. Furthermore, personal data from credit agencies, official registers and publicly accessible sources such as commercial or association registers, radio and television broadcasts, Internet, magazines, newspapers and other publications are processed. Exhibitions and trade fairs or conferences held at an event open to the public are also included.

  7. Purpose of use of personal data
  8. Personal data is processed by Alberding GmbH in compliance with the relevant laws such as the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG). This data is collected, stored and processed for the following purposes:

    • To fulfil a contract with the customer
    • Market research
    • Own statistical evaluations
    • Sending out e-mail newsletters
    • Publishing a customer reference

  10. Your personal data will be processed on the basis of the following legal bases:

    • On the basis of the consent that you have granted (Art. 6 (1 a) GDPR)
    • To fulfil a contract (Art. 6 (1 b) GDPR)
    • To fulfil legal obligations (Art. 6 (1 c) GDPR)
    • On the basis of a public interest (Art. 6 (1 e) GDPR)
    • Due to a legitimate interest (Art. 6 (1 f) GDPR)

  12. When processing your personal data, we pursue the following legitimate interests:

  13. Recipients of the personal data
  14. To fulfil our contractual and legal obligations your personal data is disclosed to various public or internal bodies, as well as to external service Providers.
    In case of your consent, your personal data will be transmitted to partner companies of Alberding GmbH, which are consulted as sales or service providers for the preparation of an offer or for the fulfilment of legal reporting obligations.

  15. Transfer to third countries
  16. Your personal data may be transferred to third countries outside the European Union. In the event that your data is forwarded, this will be performed on the basis of the contractual regulations provided by law, which are intended to ensure adequate protection of your data and which you can consult on request.

  17. Integration of third-party services and content
  18. It is possible that third party contents, such as videos from YouTube, Google Fonts or graphics from other websites, are integrated within our online offer. The prerequisite for using the contents of these providers (hereinafter referred to as "third-party providers") is the transmission of your IP address.
    We make all efforts to use only those contents whose respective providers use the IP address only for the delivery of the contents. However, we have no influence on this if the third party providers store the IP address, e.g. for statistical purposes. As far as we know, we inform the users about this.   19. Storage of personal data
  20. Alberding GmbH stores and processes your personal data for as long as is required to allow us to fulfil our legal and contractual relationship. The data is stored in the following cases:

    • your consent to the processing until you revoke your permission
    • the fulfilment of a contract for at most as long as the contractual relationship with you exists or the legal storage periods expire
    • of the legitimate interest only as long as your interest in a deletion or anonymization does not prevail
  21. Right of access, correction, deletion or limitation of processing, right of appeal against processing and right of data portability
  22. Each individual affected has under certain conditions, the right:

    • to request information on the processing of your data in accordance with Art. 15 GDPR
    • to request rectification of inaccurate personal data in accordance with Art. 16 GDPR
    • to request the erasure of personal data in accordance with Art. 17 GDPR
    • to demand a restriction of processing according to Art. 18 GDPR
    • to object in accordance with Art. 21 GDPR
    • to data portability as per Art. 20 GDPR
    • to revoke the consent to the processing of the data

    With regard to the right to information and the right to deletion, restrictions apply in accordance with §§ 34 and 35 BDSG.
    To find out your rights you can contact those officials responsible or the data protection authorities using the contact details provided. We will process your requests promptly and in accordance with the legal requirements and inform you of the measures we have taken.

  23. Obligation to provide your personal data

To enter into a business relationship you must provide us with the personal data required to implement the contractual relationship, or that we are required to collect due to legal stipulations. If you do not provide us with this data, we will not be able to implement or perform the contractual relationship.

  26. If the purpose or methods of the processing of your personal data are subject to significant changes, we will update this information in a timely manner and communicate the changes promptly.
